1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Swasthya Yoga Kendra ("we," "us," or "our"). By:

• Visiting our website
• Enrolling in our classes or programs
• Participating in our yoga sessions
• Using any of our services

You acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Services Provided

Swasthya Yoga Kendra offers the following services:

• Yoga Therapy Sessions: Personalized therapeutic yoga for various health conditions
• Corporate Wellness Programs: Yoga and mindfulness sessions for organizations
• Group Yoga Classes: Regular yoga classes for different skill levels
• Specialized Programs: Kids yoga, seniors yoga, prenatal yoga, and special needs programs
• Yoga Instructor Course (YIC): 300-hour VYASA-affiliated certification program
• Online Sessions: Virtual yoga classes and consultations
• Workshops and Events: Special yoga workshops and wellness events

3. Eligibility and Health Requirements

3.1 Age Requirements

• Participants must be at least 18 years old to enroll independently
• Minors (under 18) must have parental or guardian consent
• Children's programs require parental registration and consent

3.3 Medical Clearance

We reserve the right to require medical clearance from your physician before you participate in our programs, especially for:

• Yoga therapy sessions
• Intensive programs
• Special health conditions

4. Registration and Enrollment

4.1 Account Accuracy

You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4.3 Enrollment Confirmation

Enrollment is confirmed only after:

• Completion of registration form
• Receipt of payment (if applicable)
• Acknowledgment of health disclosure
• Written or electronic confirmation from us

5. Fees and Payment

5.1 Payment Terms

• Fees must be paid in advance unless otherwise specified
• Accepted payment methods: [Specify: Cash, Bank Transfer, UPI, Cards, etc.]
• All fees are in Indian Rupees (INR)
• Prices are subject to change with notice

5.2 Late Payments

Late or non-payment may result in:

• Suspension of access to classes
• Cancellation of enrollment
• Late payment fees (if applicable)

5.3 Refund Policy

• Class Packages: Refunds available within 7 days of purchase if no classes have been attended
• Monthly Memberships: No refunds after the first class; cancellations require 15 days notice
• YIC Course: Partial refunds available before course commencement; no refunds after course starts
• Workshops: Refunds available up to 7 days before the event date
• Special Circumstances: Refunds may be considered on a case-by-case basis for medical emergencies or serious hardship

6. Cancellation and Rescheduling

6.1 By Participants

• Class cancellations must be made at least 24 hours in advance
• Last-minute cancellations (less than 24 hours) may forfeit the class
• Rescheduling is subject to availability

6.2 By Swasthya Yoga Kendra

We reserve the right to cancel or reschedule classes due to:

• Insufficient enrollment
• Instructor unavailability
• Facility issues
• Weather conditions or emergencies

In such cases, we will provide alternative dates or full refunds.

7. Conduct and Behavior

7.1 Expected Behavior

Participants are expected to:

• Arrive on time for classes
• Respect instructors and fellow participants
• Follow instructor guidance and safety instructions
• Maintain a clean and peaceful environment
• Turn off mobile devices during sessions
• Dress appropriately in comfortable yoga attire
• Practice good personal hygiene

7.2 Prohibited Conduct

The following behaviors are strictly prohibited:

• Disruptive or disrespectful behavior
• Harassment, bullying, or discrimination
• Use of alcohol, drugs, or tobacco on premises
• Recording or photographing without permission
• Unauthorized selling or soliciting
• Any illegal activities

7.3 Consequences

Violation of conduct rules may result in:

• Warning
• Temporary suspension
• Permanent expulsion without refund
• Legal action if necessary

8. Assumption of Risk and Liability Waiver

8.1 Voluntary Participation

You acknowledge that:

• Participation is voluntary
• You are physically and mentally capable of participating
• You will inform instructors of any discomfort or concerns
• You will not exceed your personal limits

8.2 Release of Liability

To the fullest extent permitted by law, you agree to release, waive, discharge, and hold harmless Swasthya Yoga Kendra, its instructors, employees, affiliates, and representatives from any and all liability for injuries, losses, or damages arising from your participation, including:

• Personal injuries or death
• Property damage or loss
• Medical expenses
• Any other claims or damages

8.3 Insurance

We recommend that all participants maintain appropriate health and accident insurance. Swasthya Yoga Kendra does not provide insurance coverage for participants.

9. Intellectual Property

9.1 Ownership

All content on our website and in our materials, including:

• Text, graphics, logos, images
• Videos and audio recordings
• Course materials and handouts
• Teaching sequences and methodologies

Are the intellectual property of Swasthya Yoga Kendra and are protected by copyright and trademark laws.

9.2 Restrictions

You may not:

• Reproduce, distribute, or publicly display our content without permission
• Use our materials for commercial purposes
• Modify or create derivative works
• Record or photograph classes without explicit permission

10. Photography and Media Release

By participating in our programs, you grant Swasthya Yoga Kendra permission to:

• Photograph or video record you during classes or events
• Use such images or recordings for promotional purposes
• Share on our website, social media, or marketing materials

If you do not wish to be photographed or recorded, please inform us in writing.

11. Privacy and Data Protection

Your personal information is handled in accordance with our Privacy Policy, which is incorporated into these Terms by reference.

12. YIC Course-Specific Terms

Additional terms for the Yoga Instructor Course:

• Minimum attendance requirement: 90% of total hours
• Successful completion of all assignments and assessments
• Payment of full course fees before certificate issuance
• VYASA affiliation and certification subject to their terms
• Course materials are for personal use only

13. Online Sessions Terms

For virtual/online classes:

• Stable internet connection is your responsibility
• Classes may be recorded for quality purposes
• Technical issues on your end do not warrant refunds
• Zoom/platform links are confidential and not to be shared
• Same conduct and safety rules apply

14. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee:

• Specific health or fitness results
• Treatment or cure of medical conditions
• Uninterrupted or error-free services
• Compatibility with individual needs

15. Limitation of Liability

To the maximum extent permitted by law, Swasthya Yoga Kendra shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, revenue, or data
• Personal injury or property damage
• Damages exceeding the fees paid for services

16. Indemnification

You agree to indemnify and hold harmless Swasthya Yoga Kendra from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:

• Your violation of these Terms
• Your violation of any third-party rights
• Your use of our services
• Any false or misleading information you provide

17. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted on our website. Continued use of our services after changes constitutes acceptance of the modified Terms.

18. Termination

We reserve the right to terminate or suspend your access to our services at any time, without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of fees
• Any other reason at our sole discretion

19. Governing Law and Dispute Resolution

19.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

19.2 Jurisdiction

Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.

19.3 Dispute Resolution

In the event of a dispute, we encourage you to first contact us to seek an amicable resolution. If the dispute cannot be resolved informally, it may be submitted to mediation or arbitration before legal proceedings.

20. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Swasthya Yoga Kendra regarding the use of our services.
